The short answer

Illinois makes it an offence to record a private conversation surreptitiously without everyone's consent, and the word that matters is surreptitious. The assistant here records no audio and opens every call by saying it is an AI that takes notes, so nothing about it is hidden. Then it does what an answering service should in an Illinois winter: answers at any hour, recognises burst, frozen and no heat, gets the address, and leaves a complete lead or a booking for the morning.

Surreptitious is the test
Section 14-2 applies to recording or transcribing done in a surreptitious manner without the consent of all parties.

Recording is off at the carrier. What is kept is the written conversation on the lead, so the person ringing back can read it.

What is different about Illinois

  • The Illinois eavesdropping statute, 720 ILCS 5/14-2, is built around the word surreptitious. Recording a private conversation you are part of is an offence when it is done in a surreptitious manner without everyone's consent. An assistant whose first sentence is that it is an AI taking notes is the opposite of surreptitious, and that is deliberate.
  • O'Hare averages 122 nights a year at or below freezing and a January low of about 16.5°F. Frozen pipes and no heat are both emergency words in the configuration, and in northern Illinois they arrive on the same nights.
  • 79 percent of Illinois plumbing and HVAC establishments have fewer than ten staff, and 84 percent of roofing ones do. A small shop in a cold snap is one person answering a phone with gloves on, or not answering it.
  • Springfield sees more hot days than Chicago, about 23 a year at 90°F or above against 14, with fewer freezing nights. Downstate HVAC businesses get a sharper summer peak than Chicago ones and a slightly milder winter.

A frozen pipe in January

  1. A pipe freezes and splits in a Chicago bungalow during a January cold snap. Water reaches the basement ceiling and the owner calls a plumber.
  2. The assistant answers and says it is an AI taking notes, so the caller knows exactly what they are speaking to before saying a word.
  3. The caller says burst and ceiling, both on the plumbing emergency list, and the lead is raised at once.
  4. It gets the address and a callback number, reads them back, and books the first free slot if burst pipes are a job you allow it to book.
  5. The emergency text that follows tells the caller to leave and call 911 if water is near anything electrical, and says nothing more.

On the coldest nights the caller's reply usually says no heat or frozen, and those words are what moves the lead to the top of the morning list.

Questions Illinois owners ask

Is Illinois a two-party consent state?
For recording a private conversation in a surreptitious manner, the statute requires everyone's consent. The assistant is not surreptitious: it tells the caller what it is and that it takes notes before anything else.
What happens at 3am in a cold snap?
If the assistant is on, it answers and raises any call that names an emergency word. If it is off, the caller gets a text within about a minute. Either way the lead is there before your first person starts.
Can it book the job, or only take a message?
Both, by your choice. Every job type is off for booking until you turn it on, and when it is on the assistant only offers times your calendar shows as free.
